Portsmouth police reopen probe into sexual abuse claim at Portsmouth Abbey School

PORTSMOUTH — Following a sexual abuse lawsuit filed earlier this month against Portsmouth Abbey School and a former teacher, a police investigation has been reopened.

“We re-opened the case based on the information alleged in the articles recently printed,” Portsmouth police Detective Lt. John Cahoon said in an email Monday. News of the lawsuit was first reported by The Daily News on Dec. 4.

A woman filed a lawsuit on Dec. 1 in U.S. District Court against Portsmouth Abbey School and Michael Bowen Smith, her former humanities teacher, claiming Smith sexually abused her while she was a student at the preparatory school.

Newport attorney Thomas Connolly is identified as Smith’s attorney in a court filing. Connolly did not return a phone call Monday.

The complaint says “Jane Doe” was sexually abused by Smith between 2012 and 2014, her sophomore, junior and senior years at the school, The Daily News reported previously.

Portsmouth Abbey is a defendant because it “failed to take any measures to investigate and put an end to the misconduct and protect its young student,” the lawsuit says. “Also, after the sexual abuse was revealed to the school in 2015, the school allowed the perpetrator, Smith, to quietly resign and characterized the situation as simply being about ‘inappropriate emails.'”

The Daily News asked Cahoon when and why the investigation had closed initially, and whether police would investigate Portsmouth Abbey and the school’s handling of the allegation in conjunction with a probe into Smith’s alleged actions.

“As far as the previous investigation and the scope of this investigation, I don’t have any comment,” Cahoon said in an email.

Frank Pagliaro, a 2010 alumnus and former Portsmouth Abbey faculty member, said there were 82 signatures from alumni and parents attached to a letter to the school’s Board of Regents last week.

The letter, in part, called for the creation of a subcommittee of alumni, board members, staff and outside counsel to investigate the allegations.

Pagliaro said in a phone call with The Daily News on Monday the investigative subcommittee was requested before supporters knew police had reopened the investigation.

“I would say even now the [subcommittee’s] investigation is still necessary because the police are bound by laws about confidentiality, which is really important … [But the] alumni community can’t rely on law enforcement and the courts to give us that transparent account we need … what personnel or policy changes need to happen,” Pagliaro said.

Until the completion of the subcommittee’s investigation, the alumni demanded that Headmaster Daniel McDonough, Assistant Headmaster John Perreira and Board of Regents Chair W.Christopher Behnke be placed on leave or take leaves of absence.

Alumni, in the letter, raised questions about the school’s disclosure of information to the Office of the Attorney General after Smith’s departure, inquiring whether the school provided “full access to information and witnesses.”

Alumni also asked about the school’s reporting policy with abuse allegations, whether Portsmouth Abbey was contacted by a subsequent, prospective employer for Smith and whether any parent was threatened with their child’s dismissal if they conversed about the alleged events.

“We have not received any direct response” to the letter yet, Pagliaro said Monday.

When contacted Monday, Perreira referred a reporter to Providence attorney Steven Richard for comment, who is representing the school. Richard did not return a phone call Monday.

Jane Doe’s Rhode Island attorney, Timothy Conlon, emailed a statement to The Daily News on behalf of himself and David Ring, the plaintiff’s California-based attorney.

“We applaud the alumni for asking all the right questions and demanding accountability from those who run Portsmouth Abbey School. The School has remained silent this entire time, with not so much as a public apology to the victim in this case. I find that highly disturbing, but also very telling,” Conlon wrote.

“The outpouring of support for the young woman who suffered this abuse that has come from the community of alumni is amazing. In over 3 decades of dealing with cases involving such misconduct in schools, I have never seen such outreach and activism from former students and their families,” Conlon added. “We have received cards and letters, and it is very clear that Abbey alums want real change and accountability at the institution.”

Daniel McDonough will leave the job on Aug. 1 after leading the elite Catholic high school since 2013, according to a statement posted on the school’s website by its Board of Regents.

Officials did not give a reason for the departure of McDonough, who has worked at Portsmouth Abbey for 37 years in all.

“The Board is deeply grateful for his gifts and service during these eight years, and we look forward to his continued support of the school,” the statement said.

The school — which costs $67,000 for boarding students and $42,000 for day students — has been roiled in recent years by allegations that abuse claims have been mishandled.

The regents said Matt Walter, the school’s current assistant headmaster for advancement, will serve as acting headmaster.

On December 1, 2020, Ms. Jane Doe ’14 filed a federal lawsuit in Providence, Rhode Island, alleging sexual abuse by a former faculty member at Portsmouth Abbey and an ensuing coverup scheme. Many alumni of the School have since testified to the sad truth: between 2012 and 2014, these goings-on were an “open secret” on the Abbey campus.

In an effort to obtain information and create transparency for the entire School community, a group of concerned alumni sent a letter to the Board of Regents on December 16. Bearing 82 signatures, this letter requested the creation of a subcommittee to investigate the events outlined in the lawsuit. At the conclusion of its investigation, this committee would make personnel and policy recommendations towards the prevention of such abuse in the future. To ensure accountability and impartiality, the letter also demanded that senior school leadership – which was presumably a principal party to the events in question – be placed on leave immediately. This letter has not been answered, and the School has vowed silence on the matter outside of a court of law.

Entirely unsatisfied with the School’s recent statement to its alumni, parent, and benefactor community, our group has created this page to serve as a hub for unbiased news on the legal proceedings and as a platform for sharing our mission with the wider Abbey family. Simply stated: we aim to create a subcommittee that will conduct an independent investigation of the allegations contained in Jane Doe’s lawsuit. For the duration of that committee’s investigation, we seek the removal of current School leadership – Headmaster Dan McDonough, Associate Headmaster John Perreira, and Board of Regents Chair W. Christopher Behnke ’81.

We have a responsibility to protect the children in the Abbey’s care and to help the institution find visionary leadership capable of effective and ethical navigation of the obstacles presented to a 21st-century boarding school. PORTSMOUTH, R.I. — Leaders of the Portsmouth Abbey School and Monastery have released a report that contains “shameful news” of “credible allegations of sexual abuse” between 1959 and the early 1980s, and of corporal punishment in the ’60s and ’70s.

A letter emailed Wednesday to members of the Portsmouth Abbey community contained an apology to the victims of Father Bede Gorman, who died in 1985, and Father Geoffrey Chase, who is in his late 80s and is ill. He left the school in 2002, the letter said.

“We stand by those who were wronged, and are committed to helping past victims, providing therapy for them as needed.”

The letter — from Regents chairman W. Christopher Behnke ’81, Abbot Matthew Stark for the monks and Headmaster Daniel McDonough — also promised that Gorman’s name would be removed from the athletic fields, squash center and two annual prizes that had been named in his honor, and that the review of policies, safety protocols and training programs at the school would continue.

“Our hearts break for these victims and their families,” the letter said. “Their trust and faith in the sacred mission of Portsmouth was violated. On behalf of the Portsmouth Abbey School and Monastery, we apologize. And we honor and thank the survivors of sexual abuse who came forward. By sharing your stories, you have helped ensure that the past will not be repeated; the Portsmouth community is deeply in your debt.”

On corporal punishment chronicled in the report, the letter said: “We recognize that some alumni still carry emotional scars from these punishments. To them and to others who came forward and shared difficult experiences, we also offer the School and Monastery’s sincere apology.”

The monks joined the apology “for the transgressions committed decades ago; they feel deep sorrow and a special obligation to those who suffered betrayal and abuse.”

They said they are committed to helping victims by funding therapy and by devoting prayer and Masses to them and their families and others affected by the abuse.

In May 2016, after the sudden resignation of Abbot Caedmon Holmes, who acknowledged personal struggles involving “conduct inconsistent with expectations and Benedictine ideals,” the regents hired the law firm of Debevoise & Plimpton to investigate whether the abbot had committed sexual abuse, and to investigate any other allegations of sex abuse in the history of the school. No allegations were made against the abbot.

However, after that finding was reported in August, victims came forward with allegations against the two other monks.

The Catholic Benedictine boarding and day school is now coeducational and open to students in grades 9 through 12.

“We hope that through this investigation and its revelations about very sad portions of our past, we can come together again, stronger than before, and in support of those who have suffered.”
